Race for the Missing Millions Screening Program Official Rules

Eligibility:

The Race for the Missing Millions Screening Program (hereafter “Program”) is open only to legal residents of the 50 United States (including the District of Columbia) who are 35 years of age or older at the time of entry. Employees, officers, agents and directors of Boehringer Ingelheim Pharmaceuticals, Inc. (hereafter, “Sponsor”), its parent, subsidiaries, affiliates, retailers, dealers, distributors, suppliers, and advertising and promotion agencies, NASCAR, Inc., and its affiliates and each of their respective employees, shareholders, officers, directors, agents, members, personnel and assigns, Country Music Association and Project Support Team, Inc. (collectively, “Released Parties”) and their immediate family members (parent, child, sibling, spouse and each of their respective spouses, regardless of where they reside) of each of the foregoing (as well as those domiciled with them, whether related or not) are not eligible to enter or win. This Program is void in Puerto Rico and where prohibited. Subject to all applicable federal, state and local laws.

How To Enter:

The Program will be divided into two (2) Grand Prize drawings, one for each Event, as described below. The Entry Period for the Country Music Association Awards (“CMA”) Prize starts at 12:00:01PM, Eastern Time (“ET”) on 5/17/10 and ends 11:59:59PM, ET on 9/1/10 and the Entry Period for the 2011 Daytona 500 Prize starts at 12:00:01PM, ET on 5/2/10 and ends 11:59:59PM, ET on 12/1/10 (collectively, “Promotion Period”).

There are (2) ways to participate in the Program. During the Promotion Period: 1.) Online: Visit www.DRIVE4COPD.com (hereafter, “Promotion Website”), click the link to register and enter the Program and complete/submit the online entry form, including the event you would like to attend from the choices provided, to receive one (1) entry in the applicable Grand Prize drawing; 2) Participating Locations: Visit a participating Physician’s Office or attend a participating event, complete the designated entry card, including the event you would like to attend from the choices provided, in accordance with the instructions provided to receive one (1) entry in the applicable Grand Prize drawing. As part of the entry process, you will be asked to answer five (5) multiple-choice questions. Your answers to the posed questions do not affect your chances of winning. The questions are intended to assist in determining whether you are at risk for COPD. Your answers should be discussed with your doctor. Limit one (1) Program entry per person and per e-mail address (regardless of entry method) for the entire duration of the Promotion Period. Additional entries from any one person or e-mail address after the first entry received from that person or e-mail address will be void. Entries generated by script, macro or other automated means and entries by any means, which subvert the entry process, will be void. All entries become property of the Sponsor and will not be returned.

Released Parties are not responsible for late, lost, incomplete, delayed, garbled, incorrect, damaged, stolen, misdirected, undelivered or inaccurate entries; theft, destruction or unauthorized access to, or alteration of, entries; failures or malfunctions of computer, satellite, cable transmissions, phones, phone lines or telephone systems failures, or difficulties; interrupted or unavailable network, server, Internet Service Provider (ISP), website or other connections, or technical failure; miscommunications, computer hardware or software malfunctions or telephone transmission problems or technical failures, garbled transmissions, damage to a user's computer equipment (software or hardware) or other errors; traffic congestion on the Internet or any technical problem, including, but not limited to, any injury or damage to entrant’s or any other person’s computer related to or resulting from Program participation or downloading materials from the website; or other problems or malfunctions of any kind whether computer, network, human, mechanical, typographical, electronic, printing or otherwise relating to or in connection with the Program, including, without limitation, malfunctions or problems which may occur in connection with the administration or the Program, the processing of entries, the selection or announcement of the winner, the cancellation or postponement of the sporting event, the awarding of the prize or in any Program-related materials. In the event of a dispute as to the identity of an entrant based on submitted email address, entry will be deemed to be from the authorized e-mail account subscriber as determined by Sponsor regardless of the name that appears on the official online entry form and such entrant must comply with these Official Rules. “Authorized e-mail account subscriber” is deemed to be the natural person who is assigned an e-mail address by an internet access provider, on-line service provider or other organization, which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. CAUTION: Any attempt to deliberately damage any web site or undermine the legitimate operation of this Program is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and/or other remedies (including attorneys’ fees) from any such person(s) responsible for the attempt to the fullest extent permitted by law.

Random Drawing:

All Grand Prize drawing entries will be separated by event. One (1) potential Grand Prize winner will be randomly selected from among all eligible entries received for each of the two (2) events designated above (for a total of two (2) potential Grand Prize winners, one (1) per event). All drawings will be conducted by P/S/T, a third-party judging organization. The CMA Prize drawing will be conducted on or about 9/13/10 and the 2011 Daytona 500 Prize drawing will be conducted on or about 12/13/10. Odds of winning a Grand Prize will depend on the total number of eligible entries received for the applicable drawing. Potential Grand Prize winners will be contacted by telephone, email, U.S. mail &/or overnight express mail.

Prizes:

(1) 2011 Daytona 500 Prize: 4-day/3-night trip for winner and one (1) guest to attend the Daytona 500 at the Daytona International Speedway between 2/18/11 and 2/21/11. The trip includes round-trip coach air transportation from major U.S. gateway airport near winner’s residence in the U.S. to destination, three (3) nights standard double-occupancy hotel accommodations (one (1) room), ground transportation to/from the airport (1 vehicle only) and hotel while at destination, two (2) tickets to the Race, VIP passes while attending the Race and a $500 food voucher which must be used at Daytona International Speedway. Approximate Retail Value (“ARV”): $2,800. Actual prize value will vary depending on winner's city of departure. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if winner lives within a reasonable driving distance of Daytona, FL as determined by Sponsor, and to award no additional compensation or substitution for the difference in prize value. (1) CMA Awards Prize: 3-day/2-night trip for winner and one (1) guest to attend the 2010 Country Music Association Awards (“CMA Awards”) in Nashville, TN between 11/9/10 and 11/11/10. The trip includes round-trip coach air transportation from major U.S. gateway airport near winner’s residence in the U.S. to destination; two (2) nights standard double-occupancy hotel accommodations (note: room and tax only; all hotel incidentals including, but not limited to, parking, phone calls, tips, dining are responsibility of winner. Winner will be required to provide a credit card upon check-in to guarantee incidentals); ground transportation to/from the airport and hotel while at destination, two (2) tickets to the Awards on 11/10/10, two (2) tickets to a private CMA event designated by Sponsor, and one (1) CMA Awards Gift bag. ARV: $2,475. Actual prize value will vary depending on winner's city of departure. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if winner lives within a reasonable driving distance of Nashville, TN as determined by Sponsor, and to award no additional compensation or substitution for the difference in prize value. Travel and hotel arrangements determined by Sponsor in its sole discretion and must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Trip(s) must be taken on dates and times designated by Sponsor or prize(s) will be forfeited in its entirety and may be awarded to an alternate winner. Winner(s) and guest(s) must travel together on the same itinerary. Guest(s) must be of legal age of majority in his/her jurisdiction of residence (and at least 18) unless child or legal ward of winner(s). Winner(s) and guest(s) are responsible for obtaining all necessary travel documents. If any event is canceled or postponed for any reason, travel prize(s) will be awarded less applicable prize-related activities and Sponsor will substitute that activity(s) with an item(s)/activity(s) of equal or greater value as determined solely by Sponsor and Sponsor will have no further obligation to such winner(s). Winner(s) and guest(s) must comply with event venue’s rules and regulations. Failure to do so may result in forfeiture of applicable prize(s) element. Tickets are subject to certain terms and conditions specified therein. Exact seat locations at event(s) to be determined by Sponsor in its sole discretion. All prize(s) details are at Sponsor’s sole discretion. Certain travel restrictions may apply. No transfer, assignment, cash redemption, or substitution of prize(s) (or portion thereof) except by Sponsor, who reserves the right to substitute the prize(s) (or applicable portion thereof) with one of comparable or greater value (except as otherwise provided above), at its sole discretion. Federal, state, and local taxes (including income and withholding taxes) and all other costs and expenses associated with acceptance and use of a prize(s) not specified herein as being awarded are winners’ sole responsibility, including, without limitation, additional ground transportation, luggage fees, meals, souvenirs and gratuities with respect to the prize(s).

Miscellaneous:

By participating, entrants agree to abide by these Official Rules and to the decisions of the Sponsor and judges, which will be final and binding on all matters pertaining to this Program. The potential prize winner(s) will be notified by email, mail and/or telephone and required to sign and return an Affidavit of Eligibility, Liability Release and (unless prohibited by law) Publicity Release and return the completed documents in the pre-paid overnight envelope provided within five (5) business days of date of issuance. Winner(s) must complete an IRS Form 1099-MISC for the actual value of the prize and must provide his/her Social Security number. Prize winners’ guest(s) (if child or legal ward of winner, winner) will also be required to execute and return a Liability Release and (where legal) Publicity Release prior to prize award. Non-compliance with any of the foregoing, with these Official Rules, if Sponsor is unable to contact the potential winner within a reasonable time period or if prize notification is returned as non-deliverable, potential winner will be disqualified and, at Sponsor’s sole discretion, an alternate potential Prize winner will be selected from among remaining eligible non-winning entries. By entering, entrants agree: (a) that the Sponsor may, at the Sponsor’s sole discretion, use winner’s name, city and state, photograph and/or likeness and statements attributable to him/her for advertising and/or trade and/or other purposes in any and all media now known or hereafter devised, worldwide, in perpetuity, without further compensation, permission or notification, except where prohibited by law; and, (b) that the Released Parties shall have no liability and will be held harmless for any liability, loss, injury or damage to participant or any other person or entity, including personal injury or death to winner or any other person or damage to personal or real property due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize (including any travel or activity related thereto) or participation in this Program. Sponsor reserves the right, in its sole discretion, to void any and all entries of entrants who it believes in its sole discretion have attempted to tamper with or impair the Program or to disqualify any individual or cancel, terminate or suspend this Program for any reason, including should virus, bugs, worms, non-authorized human intervention, actions by entrants, or other causes corrupt or impair the administration, security, fairness or proper play of the Program and, in the event of cancellation or termination, select at its discretion, the winner from eligible non-suspect entries received prior to the event requiring such action.
